City of Edwardsville Administrative and Community Services Committee met March 16.

Here is the minutes provided by the Committee:

Present: Tom Butts, Walt Williams, Barb Stammer, Chris Byrne, Scott Hanson Mike Rathgeb, Cheryl Porter, Keith Moran, Eric Williams, Andrew Sineni, Tim Harr Eric Keith, Bob Pfeiffer

1. Approval of minutes for March 2, 2017 ACS Meeting-Motion to approve (Butts), seconded (Stamer) and voted all ayes.

3. Council Matters

A.) Filed for second reading:

1.) Ordinance Annexing 3601. First Presbyterian Church - Annexes 5.58 acre site into the City of Edwardsville - Motion to approve (Butts), seconded (Stamer) and voted all ayes to forward to Council.

B.) New Items:

1.) An Ordinance Amending Chapter 122 of the Codified Ordinances of the City of

Edwardsville (Weeds-Nuisance, removal notices, citations, etc.) - Amends the current ordinance to allow the City to more promptly respond to grass and weed height regulations, removes a discrepancy between an 8” and 12" standard, declares a nuisance for weeds & grass on residential lots and lots adjacent or adjoining residential lots, and would allow managed natural landscaping as long as it meets specific requirements of the ordinance-Alderman Butts feels this ordinance doesn't go far enough. He believes 8" is too tall. Alderman Stamerstated that was discussed at Public Services also. He would like to have it stated in there that cutting it for hay and for the purposes of baling hay is not a management practice. Alderman Stamer suggested the wording be changed in the section discussing that it's unlawful to place the debris in the street or on the sidewalk. She believes the way it's written is confusing and that it's missing something. She feels it should be Worded adding the verbiage "deliberately and intentionally placed." Eric Williams asked Alderman Butts what his intent was for the height in right-of-way, since Some of the right-of-ways are rough cut mow in contracts, Alderman Butts stated that was okay but he was primarily talking about private property. Alderman Stamer stated if we set a standard for citizens, then we should be willing to set that standard for the City as well. Committee would like to see the 8' height be changed to 6”. Motion to forward to Council for first reading with revisions as noted (Butts), seconded (Stamer) and voted alayes.

2.) An Ordinance Amending Chapter 114, Section 114-302 of the Codified Ordinances of the City of Edwardsville (Parking Prohibited at all Times)-pending recommendation of approval from Public Safety and Public Services Committees - Alderman Stamer read a letter from a concerned citizen who lives on Elm St. regarding this. This individual does not agree with restricting the parking to one side of the street. Committee discussed whether there really is a need for this ordinance. They think the stretch of Elm St. from St. Louis St. to Randle St. seems to be the only area where this could be beneficial. Motion to forward to Council for first reading (Butts), seconded (Stamer) and voted all ayes.

3.) Items forwarded from March 7, 2017 RASE Board for approval:

• Edwardsville Education Assoc. - Prop E Rally 3/25/17 City Park - Motion to approve (Butts), seconded (Stamer) and voted all ayes. 

• EHS Key Club Easter Egg Hunt 4/8/17 - City Park - Motion to approve (Butts), seconded Stamer) and voted all ayes.

• Edwardsville Rotary Club: Criterium 8/19/17-Downtown Streets - Motion to approve (Butts), seconded Stamer) and voted all ayes.

C.) Items held in Committee:

1.) Resolution Authorizing an Amended Intergovernmental Agreement for Lewis and Clark Community College Sign-Amends 2007 Intergovernmental Agreement regarding the approved location, design, and size of sign - Petitioner has requested this item continue to be held at this time - Held 10/27/16-Will continue to hold.

2.) An Ordinance Amending Chapters 1242, 1248, and 1252 of the Codified Ordinances of the City of Edwardsville (Zoning District Regulations, Scope of Regulations and Definitions) Amendment modifies size of lots allowable for percent of coverage through administrative review, allows architecturally sympathetic reconstruction for non-conforming single family residences located in R-1 Districts to be rebuilt to original building footprint provided allowable setbacks are maintained; and general language housekeeping of other affected portions of the zoning ordinance (Ordinance has been revised and is reflective of changes discussed at 2/16/17 & 3/2/17 ACS) - Held 2/16/17 & 3/2/17 - At the last ACS meeting, it was discussed changing the wording from "architecturally sympathetic' to architecturally Consistent". In addition, a footnote was added to refer readers to the small lot overlay district. Alderman Butts stated he likes this ordinance as he is a proponent of infill. Motion to forward to Council for second reading (Stamer), seconded (Butts) and voted all ayes.

3.) Resolution Authorizing an Agreement to Encourage Redevelopment within the

Montclaire Business District - Agreement stipulates the criteria for reimbursable expenditures to the developer within the Montclaire Business District - Held 3/2/17Walt Williams began discussion. Developer brought in material that will be used for the back lot and the revisions to the Rapid Lube. Tim Harr stated one thing they wanted clarification on was the plan showing parking. Currently, it is more or less a conceptual plan. They would like to see an engineered plan that shows a better traffic flow. Alderman Butts asked if everyone on staff is satisfied with what is and what is not going to be accepted for reimbursement. Walt Williams responded that staff is fully in support of the package being presented. Alderman Butts asked about the height of the fence. Walt Williams said it was still 8 feet. Alderman Stamer would like to see a rendering of the back side of the retaining wall at Rapid Lube. It was suggested that staff from Public Works inspect the current retaining wall to make sure there are no safety concerns. Alderman Butts told developers to come with a drawing of the back of the retaining wall in order for it to be considered. Motion to forward to Council (Butts), seconded (Stamer) and voted all ayes,
