City of Belleville Ordinance and Legal Review Committee met Feb. 11.

Here is the minutes provided by the committee:

Alderman Wigginton called the meeting to order.

Aldermen present on roll call: Alderman Hazel, Alderman Randle, Alderwoman Stiehl and Alderman Wigginton.

Aldermen absent on roll call: Alderwoman Puss.

Staff Present: City Clerk Meyer, City Treasurer, Dean Hardt; City Attorney Hoemer (arrived at 5.05 p.m ), Assistant Fire Chief, JP Penct.

Guest Present: Wendy Pfeil, Chamber ofCommerce

PUBLIC PARTICIPATION

None.

MINUTES

Alderman Randle made a motion seconded by Alderwoman Hazel to accept the minutes of January 13, 2020.

All members present voted aye.

UNFINISHED BUSINESS

None.

MISCELLANEOUS& NEW BUSINESS

Alderman Randle made a motion seconded by Alderman Hazel to repeal Section 111.02 (Fireworks) from Chapter 111 (Amusements and Recreation; Raffles).

City Clerk, Jenny Meyer, advised she and Assistant Fire Chief,JP Penet, discussed and when Code of Ordinances was codified in 2015 this should have been repealed at that time. This business license is not offered, when calls are received, they are forwarded to the fire department. City Clerk Meyer stated Section 111. 02 will be removed from the Code of Ordinances.

Assistant Fire Chief, JP Penet, advised when the ordinance was adopted to follow state law regarding the sale and use of fireworks that also precluded the sale and this is a separate license that was not removed at that time. Ifthis is removed there will no longer be a conflict.

Alderman Randle ask if 111. 02 ( Fireworks) will be removed; City Clerk Mayer stated yes.

Members voting aye on roll call: Hazel, Randle, Stiehl, Wigginton. (4)

Discussion on drafting an ordinance or amending Section 162.504(E) of the Zoning Code regarding minimum standards on number/size of toters in a multi-family development.

Alderman Hazel stated the reason for this ordinance is that we do not have an ordinance that establishes minimum standards, dumpster sizes, pick up requirements, refuse removal on multi- family dwellings. This ordinance proposal applies only to residential developments. Alderman Hazel advised the typical amount of trash that is removed as far as an industry standard is. 33 yards per dwelling. Our toters are.5 yard each.

Alderman Hazel' s recommendations are based off the calculations that 1- 4 units can be taken care of with a single toter; 5- 6 a two-yard container; 7- 12 a four-yard container; 13- 18 a six-yard container; 19-24 eight-yard container. This will be weekly or bi-weekly pickup.

Alderman Randle spoke about the calculations regarding toters for 1- 2 units etc. Alderman Hazel stated 4 units and above the ordinance states it must be privatized trash service. The city is not equipped to pick up dmnpsters.

Alderwoman Stiehl stated the landlords need to have specific requirements.

Alderman Hazel advised he got the calculations from Waste Management and National Standards for units of multi-family dwellings.

City Clerk Meyer asked if there was an in-depth discussion at RCDS regarding this subject; if so, how will it be enforced and who will be checking it. Alderman Hazel advised this was addressed. The city will not go to every apartment building to check compliance; however, as complaints came through the ordinance will be available to inform the owner.

City Attorney Hoerner advised he has the table and will draft an ordinance and bring it back for discussion.

Discussion on drafting an ordinance for" single use bags".

Alderwoman Stiehl stated there have been several public comments against the use of plastic bags. City Clerk Meyer advised she made a chart, checked with IML and Municipal Clerks of Illinois. There are only three towns in the State, Edwardsville, Woodstock and Oak Park with similar ordinances. They have all adopted a. 10 cent fee per bag.

Alderman Randle asked Alderman Wigginton to recap the West End meeting. Alderman Wigginton stated it was unanimous to implement a no plastic bag policy.

Alderman Randle advised he agrees with the City Clerk to take a more regional approach in terms of getting other communities on board.

Alderman Hazel stated he is an environmental guy; however, he does not want to see Belleville lead the area in banning plastic bags nor would he want to establish a. 10 cent fee that the store would recoup 100%.

Wendy Pfiel, Belleville Chamber ofCommerce, stated Edwardsville policy does not go into effect until April 2020. There were businesses in Edwardsville that were opposed to this policy and wanted it as a voluntary program not ordinance mandated. The citizens were not happy that the businesses were keeping the fee. Ms. Pfeil recommended surveying the local businesses to get their feedback.

Alderman Hazel stated on an outright ban on plastic bags will not be able to be policed due to bags from other communities.

Alderman Hazel would like to save the environment by not using plastic bags and to promote the use of reusable bags. Make this part of our consumer reports.

Alderman Wigginton wants to create a campaign" Keep Belleville Beautiful".

City Clerk Meyer advised the state' s legislature brings this subject up every year as a Bill. Also, the paper bags are also included in this. This is just not about the decomposition of the bags it' s also about litter and trash.

Alderwoman Stiehl made a motion seconded by Alderman Randle to adjourn the meeting at 5: 50p.m.
