City of Collinsville City Council met Aug. 25.

Here is the minutes provided by the council:

A. CALL MEETING TO ORDER

Mayor Miller called the meeting to order at 6:30 pm.

B. ROLL CALL

Also present: City Manager Mitch Bair, Corporate Counsel Steve Giacoletto, and City Clerk Kim Wasser. 

Present: 5 - Councilman Donna Green, Councilman David Jerome, Councilman Tony Hausmann, Councilman Jeff Stehman, and Mayor John Miller

E. PROCLAMATIONS/RECOGNITION/PRESENTATIONS

1. Proclamation - 50 Years of Emergency Medical Services

Mayor Miller read the Proclamation and spoke of the benefits of having emergency medical services. He thanked medical service staff for their efforts.

2. Introduction of New City Employee:

Jed Robbins, Administrative Assistant - Parks and Recreation Department

Mayor Miller welcomed Jed Robbins.

3. Recognition of Bob Teichgraeber

Mayor Miller read the recognition letter, thanked Mr. Teichgraeber for his service and wished him a

happy 100th birthday.

4. Presentation of the Yard of the Month Contest Awards (May - August 2020)

May - Eric Samuels, 12 Delta Dr.

June - Danny and Patty Lutz, 1009 Edwards St.

July - Phyllis Kessler, 725 Maple St.

August - Denise Purcell, 146 Helen Pl.

Mayor Miller presented each winner with a plaque and gift certificate from Creekside Nursery.

F. BUSINESS PRIOR TO PUBLIC INPUT

1. Ordinance Repealing and Replacing Section 17.060.260 (Development Guidelines; Nonresidential Uses in All Districts) and 17.080 (Landscaping, Screening, and Buffering) of Title 17 (Zoning) of the Code of Ordinances of the City of Collinsville

Community Development Director Travis Taylor introduced new City employee Caitlin Rice, Associate Planner.

Overview by Ms. Rice, who advised this is a text amendment updating and clarifying commercial development guidelines in order to fit current intent. She highlighted the proposed development guidelines and gave examples of. She explained landscaping requirements and point assessment for various plants. She pointed out that a last minute revision was done to the ordinance omitting exemption for UCD and B-2 District. She further advised this was the only change since last presented and discussed.

A motion was made by Councilman Green, seconded by Councilman Stehman to approve. The motion carried by the following vote:

2. Ordinance Rezoning Real Estate Owned by the City of Collinsville, from "R-1," Single Family Residential District, to "P-R-1," Planned Single Family Residential District (511 and 513 Johnson Hill Road)

Director Taylor advised this ordinance would rezone the property from R-1 Single Family to P-R-1

Planned Single Family. He described the property as being the future site for the City's Public Works

Facility. He explained the planned district would allow for permitted land uses, structure height, parking, and landscaping as screening from surrounding properties. He mentioned adding in additional landscape/trees as a noise buffer.

Councilman Jerome asked for clarification as to why the property is being zoned Planned Single Family instead of Commercial. Director Taylor explained a commercial zoning would allow for various uses while the planned single family stays specifically to the use being permitted. City Manager Bair advised the planned district restricts the use as to only municipal operations.

City Manager Bair advised the City is not in a position to finance the improvements to this property at this time due to COVID. Bids will be requested but groundbreaking is to be determined. He advised a separate bid will be obtained for the water building.

Mayor Miller spoke of the reasons and benefits for relocating and combining the facilities.

A motion was made by Councilman Hausmann, seconded by Councilman

Jerome to approve. The motion carried by the following vote:

G. COUNCIL DISCUSSION

H. SPEAKERS FROM THE FLOOR

Mark Harris spoke of concerns with the Public Works development. He mentioned the amount of traffic it could generate. He spoke of other traffic issues in the neighborhood. He spoke of the creek littered with trash. He inquired of road salt leaking into the creek. He spoke of noise issues from work trucks. He inquired of other potential sites. He asked that traffic issues be addressed.

Nathan York voiced his concerns with the location of the Public Works facility. He mentioned concerns with the development as many homes set at a higher elevation than the site. He inquired as to the size of trees that would be used as sound buffers.

I. COMMENTS & ANNOUNCEMENTS - MAYOR

Mayor Miller spoke of needing to use the City's EMS services. He mentioned an injury sustained by his wife. He thanked the paramedics for their services and the public for their prayers.

J COMMENTS & ANNOUNCEMENTS - COUNCIL MEMBERS

Councilman Jerome congratulated EMS for rendering quality service for 50 years. He wished Mrs. Miller a speedy recovery. He welcomed Jed Robbins as a new employee. He gave recognition to the schools and teachers in the area who have been adapting during the pandemic.

Councilman Stehman advised that staff will speak with and address concerns regarding the development of the Public Works Facility. He advised the City is wanting to be a good neighbor and will address ways to mitigate noise and appearance. He spoke of the number of new COVID cases and the need to comply with CDC regulations.

Councilman Green thanked the gentlemen for voicing their concerns for their neighborhood.

Councilman Hausmann also thanked the speakers. He too spoke of the need to follow CDC regulations.

Mayor Miller mentioned new legislation from the Illinois Liquor Control Commission allowing local liquor commissioners to revoke liquor licenses for a period of 7 days for those establishments who are not adhering to COVID 19 requirements.

K. COMMENTS & ANNOUNCEMENTS - CITY STAFF

City Manager Bair gave an update regarding COVID. He advised a letter was sent to hospitality type businesses addressing the last enhanced mitigation. He mentioned receiving repeat complaints of service staff not wearing masks at various establishments. He spoke of new orders from IDPH regarding service staff and patrons needing to wear mask when interacting. Additional clarification will be sent to the establishments.

He spoke of the Public Works Facility. He advised the property was selected over 3 years ago because it was centrally located and adequate in size (20 acres). He advised the property was originally approved for a subdivision with over 100 lots. He mentioned the traffic impact a subdivision of that size would have had to the existing neighborhood in comparison to the facility. He advised the City will utilize 3 acres in the middle of the property allowing for a buffer from the neighborhood. He spoke of Mayor Miller living within close proximity of the development. He advised the existing neighborhood was taken into consideration when designing the facility and its layout. He mentioned the property by the high school recently sold for more than $800,000. The City was able to obtain a larger parcel, in the middle of the City, for $300,000. He spoke of improvements to the area in conjunction with the development. Councilman Green addressed the concern of salt leaking into the creek. She explained the road salt is exposed to the elements at the current Street Department facility. At the new facility, the salt will be enclosed and covered.

Kimberly Caughran, Director of Parks and Recreation Department, mentioned various events underway. She spoke of the Camp KAHOK (Kids, Activities, Homework and Online Knowledge) Program, yoga class, and City-Wide Yard Sale. She gave a brief update on aquatics as the season comes to an end on Labor Day.

City Clerk Wasser read the Consent Agenda.

1. Motion to Approve Payment of Bills for the Period Ending August 14, 2020, in the Amount of $1,424,965.04

2. Motion to Approve Payroll for the Period Ending August 7, 2020, in the Amount of $1,495,536.09

3. Motion to Approve Minutes of the July 28, 2020 Council Meeting

4. Resolution Reappointing Members to the Collinsville Cool Cities Committee (Jerry Young and Roger Glotfelty)

Mayor Miller asked if the Council wished to pull any items prior to a Motion.

No items were pulled. A motion was made by Councilman Jerome, seconded by Councilman Hausmann, to approve the Consent Agenda. The motion carried by the following vote:

M. NEW BUSINESS

1. Ordinance Authorizing the Second Extension of a Lease Agreement Between the City of Collinsville and L & N Partners Relative to the Use of the Parking Lot at the Gateway Fun Park City Manager Bair advised this is an extension to the previously approved lease with L & N for the use of the Gateway Fun Park parking lot in which HCI will utilize to alleviate parking along the roadway on Eastport Plaza.

A motion was made by Councilman Stehman, seconded by Councilman Green to approve. The motion carried by the following vote:

Aye: 5 - Green, Jerome, Hausmann, Stehman, and Miller

2. Ordinance Authorizing the Second Extension of a Lease Agreement Between the City of Collinsville and HCI Relative to the Use of the Parking Lot at the Gateway Fun Park City Manager Bair advised this is an extension to a previously approved lease agreement with HCI for the use of the parking lot at Gateway Fun Park. He advised HCI has agreed to reimburse the City for any improvements to the lot.

A motion was made by Councilman Jerome, seconded by Councilman Green to approve. The motion carried by the following vote:

3. Ordinance Authorizing the Mayor to Sign an Agreement Between the City of Collinsville and Steve Giacoletto of Giacoletto Law Firm (Corporate Counsel and City Attorney)

Overview by City Manager Bair, who advised this ordinance authorizes an agreement with Steve Giacoletto to perform legal services as both Corporate Counsel and City Attorney. He advised that many City cases involved Corporate Counsel as well so having one individual serve both functions would save the City up to 20% on legal fees. He outlined the terms of the agreement through March 31, 2024. It is for an initial one year term with 3 succeeding one year increments and each extension allows for a 30 day period to terminate. Compensation is at $190,000 with a 2% increase annually. He displayed a comparison of legal expenses for the past few years showing this process would have been a cost savings of $125,000.

Councilman Jerome advised he will abstain from voting due to his personal relationship and professional encounters with Mr. Giacoletto over the years.

Mayor Miller spoke of working with Mr. Giacoletto since 2005 as Corporate Counsel.

A motion was made by Councilman Hausmann, seconded by Councilman Green to approve. The motion carried by the following vote:

4. Ordinance Extending the Declaration of Local Public Health Emergencies Resulting from and in Relation to the Coronavirus Disease 2019 (Continuous)

City Manager Bair advised this ordinance extends the Declaration of Public Heath Emergency as a result of COVID 19 every 28 days continuously until terminated by the Mayor or repealed by Council. Original ordinance was approved on March 23, 2020 and extended on May 12 and June 9.

He explained the purpose of the declaration is to outline parameters on behalf of the City to ensure operations are not disrupted.

A motion was made by Councilman Green, seconded by Councilman Stehman to approve. The motion carried by the following vote:

5. Ordinance Extending the Authorization for the City Manager to Act During the State of Emergency and Local Disaster (Continuous)

Overview by City Manager Bair, who advised this ordinance extends the City Manager's authority to act during emergencies and local disasters every 28 days continuously until the Declaration of State of Emergency is terminated by the Mayor or repealed by Council. Original ordinance was previously approved on March 23, 2020 and extended May 12 and June 9.

A motion was made by Councilman Jerome, seconded by Councilman Hausmann to approve. The motion carried by the following vote:
