City of Lebanon City Council met Oct. 28.

Here is the minutes provided by the council:

The council met in regular session in the council chambers with Mayor Wilken presiding. The meeting was called to order at 7:00 p.m.

Roll Call: Aldermen Diliberto, Fero, Gale, Jenkins, Mack, Witty, Wright and Zurliene – present.

Mayor Wilken led the council and assembly in the Pledge of Allegiance.

Aldermen Mack/Jenkins MOTIONED to approve the minutes of the October 14, 2019 meeting as presented.

Roll Call: Aldermen Diliberto, Fero, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 8 yeas.

MOTION carried. 8-0

Aldermen Jenkins/Zurliene MOTIONED to approve the bills as presented.

Roll Call: Aldermen Diliberto, Fero, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 8 yeas.

MOTION carried. 8-0

COMMITTEE REPORTS:

Streets/Alleys – MEET November 4, 2019 at 7:00 p.m.

1. No report from committee but mayor asked that the committee study the possibility of applying for a grant. Usually the state pays 80% the City picks up 20% plus engineering costs at around 15% or fixing the street to the best of our ability. Superintendent McNeese wanted to include a maintenance program.

Finance – MEET November 18, 2019 at 7:00 p.m.

1. Chairman ask that everyone review the audit and report back any questions they have so that the auditors could explain.

Ordinance – MEET November 4, 2019 at 7:00 p.m.

1. A sample of a Food Truck ordinance was sent out to aldermen and was discussed. There was a request that the specifications needed to be reviewed. So, the ordinance was sent back to committee.

Water/Sewer – MEET November 18, 2019 at 7:00 p.m.

1. Report of the adding of lines and cell phones for the city hall and 4 phones (3 for street and 1 for Building/code official) It deemed proper to move forward on this topic to secure these items.

2. Our city hall phone system is outdated and insufficient. The Aldermen Witty/Diliberto MOTIONED to accept the Telepower bid of renting phone for 36 months at $2592.00 with additional labor/installation costs in the amount of $1136.00 for a total price of $ 3,728.00.

Roll Call: Aldermen Diliberto, Fero, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 8 yeas. MOTION carried. 8-0

Cemetery – MEET November 4, 2019 at 7:00 p.m.

Health/Safety – MEET November18, 2018 at 7:00 p.m.

Public Property – MEET November 4, 2018 at 7:00 p.m.

1. The chairman presented the Municode Website information to the council. This was the recommendation of Katy Storie who will be controlling the updating of materials. Municode proposed a setup fee of 4600.00 plus a maintenance fee of $1800.00 per year on a four-year contract totaling $11,800.00. Municode will bill $2950.00 per year for 4 years. At the end of four years we can renegotiate the maintenance part of the contract.

Aldermen Fero/Diliberto MOTIONED to accept the website bid from Municode of a four year at yearly payments of $2950.00 which includes the $1800.00 maintenance fee.

Roll Call: Aldermen Diliberto, Fero, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 8 yeas. MOTION carried. 8-0

2. Property owners have asked that the remaining tree truck located at 217 W. Main St. be taken down instead of doing a sculpture.

Personnel – MEET November 18, 2018 at 7:00 p.m.

1. Police Staffing issue *

* Executive Session under 5 ILCS 120 Sec 2(c)(1) of the Open Meeting Act for consideration of the appointment, employment, compensation, discipline, performance, or dismissal of specific employees

of the public body or legal counsel for the public body, including hearing testimony on a complaint lodged against an employee of the public body or against legal counsel for the public body to determine its validity.

Clerk –

1. “Trick or Treating” hours for the City shall remain on October 31st from 6 p.m.to 8 p.m.

The mayor, through executive order, closed the 100, 200, and 300 blocks of St. Louis St. on Friday to accommodate the rescheduling of the Chamber of Commerce’s “Trunk or Treat”.

Treasurer

1. The Treasurer presented two option for the tax levy. One of zero percent and the other of 2.9%. The committee recommended to approval a RESOLUTION APPROVING THE ESTIMATE OF TAXES TO BE LEVIED FOR 2019, PAYABLE IN 2020 of 2.9% Resolution 011-2019

Roll Call: Aldermen Diliberto, Fero, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 8 yeas. MOTION carried. 8-0

2. Next month will be the completion of 50% of the budget.

3. Azavar Contract Information was discussed as to whether the city should formally terminate the contract with the result being that Attorney should contact Azavar to see if they would lower their percentage share if we continue the contract.

Water – Superintendent Zimmerman requested approval to repair, at $3272.88, a sewer camera which is broke. To expedite this repair the Mayor, Superintendent and Water/Sewer Chairman Zurliene approved the expenditure according to emergency policy.

1. Alderman Witty updated information concerning the warning sirens and will report back at nest council.

2. Committee will continue to get the marijuana ordinance researched and ready for approval.

3. Alderman Diliberto/Jenkins Motioned to approve a resolution MAKING SEPARATE STATEMENT

OF FINDINGS OF FACT IN CONNECTION WITH ORDINANCE GRANTING REQUEST FOR RENEWAL OF SPECIAL USE PERMIT FOR OPERATING AN OFFICE IN A SINGLE-FAMILY HOUSE AT 403 W. CENTER STREET

Roll Call: Aldermen Diliberto, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 7 yeas. Alderman Fero - Abstain MOTION carried. 7-1 Resolution 12-2019

4. Alderman Diliberto/Gale Motioned to approve a resolution MAKING SEPARATE STATEMENT

OF FINDINGS OF FACT IN CONNECTION WITH ORDINANCE GRANTING REQUEST FOR SPECIAL USE PERMIT FOR OPERATING AN OFFICE IN A SINGLE-FAMILY HOUSE 615 BELLEVILLE STREET

Roll Call: Aldermen Diliberto, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 7 yeas. Alderman Fero - Abstain MOTION carried. 7-1 Resolution 13-2019

5. Alderman Diliberto/Zurliene Motioned to approve an Ordinance GRANTING REQUEST OF McKENDREE UNIVERSITY FOR RENEWAL OF SPECIAL USE PERMIT FOR OPERATING AN OFFICE IN A SINGLE-FAMILY HOUSE AT 403 W. CENTER STREET

Roll Call: Aldermen Diliberto, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 7 yeas. Alderman Fero - Abstain MOTION carried. 7-1 Ordinance 1470

6. Alderman Wright/Diliberto Motioned to approve an Ordinance GRANTING REQUEST OF McKENDREE UNIVERSITY FOR SPECIAL USE PERMIT FOR OPERATING AN OFFICE IN A SINGLE-FAMILY HOUSE AT 615 BELLEVILLE STREET

Roll Call: Aldermen Diliberto, Gale, Jenkins, Mack, Witty, Wright and Zurliene – 7 yeas. Alderman Fero - Abstain MOTION carried. 7-1 Ordinance 1471

7. Update on Phase 2 and 3 in the McKendree Park and Merrill/Roger Dr will be looked at by Superintendent McNeese after he attends the MS4 meeting.

8. The topic concerning “committee make up” will be on the 11/04/2019 committee agenda

New Business

The Mayor place the regular meeting into recess at 8:15 p.m. to go into Executive session under 5 ILCS 120 Sec 2(c)(1)

There was a 6-minute break before going into Executive Session. Entered Executive session at 8:47 p.m.

Adjournment – with no further business to be conducted, Aldermen Diliberto/Zurliene moved to adjourn the meeting. Hand vote to approve – 7 yeas Motion carried. Meeting adjourned at 9:03 p.m.
