CITY OF BELLEVILLE, ILLINOIS CITY COUNCIL MEETING MINUTES COUNCIL CHAMBERS—CITY HALL FEBRUARY 3, 2020— 7:00 PM

City Clerk Meyer called this meeting to order.

City Clerk Meyer explained the disaster procedures and reminded anyone speaking this evening to step up to a microphone because the meetings are being taped and posted the next day on the website.

City Clerk Meyer called roll. Members present on roll call: Alderman Kinsella, Alderman Hazel, Alderwoman Duco, Alderman Randle, Alderman Ferguson, Alderman Anthony, Alderman Ovian, Alderman Dintehmn, Alderwoman Schaefer, Alderwoman Stiehl, Alderman Rothweiler; Alderman Elmore, Alderman Weygandt, Alderman Wigginton, Alderman Barfield.

Mayor Eckert and Alderwoman Puss, are excused.

Alderman Anthony made a motion seconded by Alderman Hazel to appoint Alderman Kinsella as, Temporary Chairman of Meeting, pursuant to Section 3. 1- 35- 35(b) of the Illinois Municipal Code( 65 ILCS 5/ 3. 1- 35- 35( b)).

PUBLIC PARTICIPATION

Dan Hustedt. Carrineton Way Requesting City Council to deny the request for multi-family residential development based on traffic congestion, adding additional rental housing to the Belleville area and the impact on school districts.

Diane Wild, Turtle Creek She understands the city council agenda includes a vote on the Zoning Board of Appeals recommendation to deny MVAH Holdings LLC thew request for a special use permit to build a 64 unit rental complex eligible for federal low-income tax credit. The proposed development is adjacent to her community. She would like to go on record in support ofthe Zoning Board of Appeals recommendation to deny this special use permit.

She is a teacher and having taught for 43 years, her concerns are two-fold. The students for the proposed development would attend Abraham Lincoln School which is already at capacity. If students don' t attend Abraham Lincoln School would they have to be bused to another school. This can create a potential safety issue for students on school buses. She has seen school buses stopping on Frank Scott Parkway at the entrance of Sullivan Farms to pick up and drop off students. This is a 50-mph speed limit. She has also seen school buses coming from Sullivan Farms trying to enter Frank Scott Parkway and again in a 50-mph speed limit zone.

The development has one entrance/exit; therefore, buses will be stopping on Frank Scott Parkway to pick up students or picking them up in the development and trying to enter Frank Scott Parkway in a 50-mph zone.

This is very dangerous. She hopes the council will accept the Zoning Board of Appeals recommendation to deny MVAH Holdings LLC request.

Merdith Lucas, Turtle Creek She urges the council to honor the recommendation of the Zoning Board of Appeals to deny the request of MVAH Holdings LLC for a special use permit to build a large apartment complex. There are several issues with the proposed construction. The impact, with so many units, paving the area for over 100 parking spaces, will have on the wetland and wooded area between Turtle Creek and the proposed complex.

In Turtle Creek HOA Rules and Regulations they recognize the importance of protecting the wooded areas which surround their community on three sides. As good stewards of the woods and wetlands they cannot make changes which diminish them.

They do not allow property alterations which might negatively impact drainage or cause erosion. They have had erosion problems which they paid to fix.

Homeowners have been required to replace trees that have fallen or died naturally. Besides the wetlands and wooded area, they wish to protect the bird species during the year, even snakes and turtles. They frequently see deer, turkeys, hawks, owls and an occasional eagle. She asked the council to help protect the natural barriers Belleville still has and deny the request of MVAH Holdings LLC.

Chris Byron, Attorney Reuresenting Midwest Petroleum Midwest Petroleum owns the property adjacent to where the proposed apartment project is being proposed. While Midwest Petroleum does not take the position one way or the other with respect to the application. What they would say if the City is inclined to grant their request, Midwest Petroleum would request at least an opportunity for you to revisit the issue with respect to lighting the intersection. They do not feel the traffic there without the light will be sufficient to handle the volume of traffic.

He is in support of the Zoning Board of Appeal decision. He has other concerns and that is first responders. There is no egress for Sonnenberg, Metrolink Station, Convenient Store and Metro and the Convenient Store share a road. There is not egress for Turtle Creek nor for Carrington. There is for Sullivan Farms.

Name Inaudible First Responders have had to go over berms, there is no place for them to go. The extra congestions will put the fire, police and ambulance at risk. Those will say " we couldn't get through". They are facing this now without the extra addition.

Loretta Davidson, Turtle Creek She agrees with the Zoning Board of Appeals deny this request. She is concerned with the traffic congestion; the daily traffic far exceeds the original design limits. In the past year the Belleville and Swansea police departments have recorded 16 vehicle accidents on the %: mile stretch of Frank Scott Parkway between Hwy 161 and Llewellyn. Frank Scott will be the only entrance/exit point for[ his new development as it is for Turtle Creek and Carrington Place.

In conversation with the County they were informed there are no plans or budget for any significant modifications to this section ofFrank Scott Parkway in the foreseeable future.

Further, it has been further documented and publicized safety issues with Metrolink they do not believe residents of this proposed community will use it to the extent the developer anticipates. Thus, adding up to 157 vehicles to this already congested and dangerous section of road without considerable modification to add traffic signals does not seem wise.

Elaine Watson, Sullivan Farms She is the HOA President for Sullivan Farms. This proposed development will be adjacent to the Sullivan Farms community. She would like to go on record in support of the Zoning Board of Appeals recommendation to deny the special use request. She is concerned with traffic congestion. Sullivan Farms has a front and back entrance/exit. Their community is used as an exit when there is congested traffic on Frank Scott and Sullivan Farms. Their streets have been tom up from the overload of traffic. They have requested Swansea police to come to control.

Pat McClain, Carrie¢ton Place She would like to go on record in support of the Zoning Board of Appeals recommendation to deny the special use permits.

The location of the development poses a risk to children who live there. Many of them will be unsupervised in the proximity of the Metrolink parking lot. This will make them vulnerable to sex trafficking and drugs with so many people coming in and out.

If crime follows into the area it will only shed another dangerous Metrolink station and will impact the safety of the walking/bicycle trail.

Remember this will be a permanent development. think about what it will look like in 50 years and compare that to others you have observed in Southern Illinois.

Eric Booth, Carrineton Place In speaking with developers, they referenced a 26-page document from the Zoning Commission of Stanford University which shows that in affluent neighborhoods add a development like this decreases values of home by 2. 5%. Therefore, we are looking at a decrease in the home value of 1. 5 million dollars to the community as a result.

Asking to consider this when making the decision. He is in support of denial.

Gwen Vicari, Turtle Creek She would like to go on record in support of the Zoning Board of Appeals recommendation to deny the special use permit. She is concerned with one area and that is the ongoing management of the property. The developer has indicated that one part-time manager and one part-time technician will manage the property. She does not feel that is adequate of a property of this size.

They we further concerns with the ongoing maintenance program and the source of capital needed for long tern needs i.e. roofreplacement and major street repairs. Another concern is the long-distance ownership in the management.

APPROVAL OF MINUTES

Alderman Wigginton made a motion seconded by Alderman Weygandt motion to approve City Council Meeting Minutes and Executive Session Minutes of January 21, 2020.

Alderman Dintehnan made a motion seconded by Alderwoman Schaefer to approve claims and disbursements in the amount of$949,323.39 and payroll in the amount of$556,821. 97.

UNFINISHED BUSINESS

Alderman Elmore stated there is a house missing on the City Attorney report and would like clarification as to why 500 Park was taken off the demolition list; Director of Residential and Commercial Development Services, Annissa McCaskill advised this house is eligible for demolition; however, the City is still waiting for response to the RFP and that date is February 17, 2020.

MISCELLANEOUS & NEW BUSINESS

Alderman Dintelman made a motion seconded by Alderwoman Stiehl to approve Motor Fuel Claims in the Amount of $346.37.
