Mayor Gregory called this meeting to order at 7:00 p.m.

City Attorney Hoerner called roll. Members present on roll call: Alderperson Whitaker, Alderperson Schneider, Alderperson Duco, Alderperson Eros, Alderperson Randle, Alderperson Ferguson, Alderperson Anthony, Alderperson Ovian, Alderperson Dintelman, Alderperson Schaefer, Alderperson Stiehl, Alderperson Rothweiler, Alderperson Elmore, Alderperson Sullivan, Alderperson Osthoff.

PUBLIC PARTICIPATION 

John Eachus: President Local Firefighters 53. We wanted to thank the City and also the citizens of Belleville for helping with the Fill the Boot drive, we were able to collect $8,500 for MDA and we will present the check on August 27th during the telethon.

Sean McElligott: 124 South 18th Street. I noticed on the last couple of (inaudible) Belleville slipped again. I know those estimates are often not accurate. (Inaudible) sections of the town are not actually incorporated into the town. I feel that Belleville City Government, I'm sure there are laws on it, of the probability being more aggressive on annexing parts. I've noticed that a lot of the new subdivisions, like near Scott, are not in the town even though they have a Belleville Postal Codes. I think that I don't know the legal side of it, but I think Belleville should maybe try to annex some of that. It may not actually help organically make the town bigger, but on paper it could.

PRESENTATIONS, RECOGNITIONS & APPOINTMENTS 

Mayor Gregory recognized the character word of the month "Caring" meaning being compassionate and showing others you care.

Alderperson Eros made a motion second by Alderperson Schaefer to approve Mayor Gregory's appointment of Don LaChance as Director of Recreation effective August 9, 2023 at 12:01a.m., pursuant to Section 31.056 of the City's Revised Code of Ordinances and finding that such position requires technical training or knowledge as set forth in the applicable job description within the meaning of Section 31.031(A) of the City's Revised Code of Ordinances.

APPROVAL OF MINUTES 

Alderperson Schneider made a motion second by Alderperson Schaefer to approve the City Council Meeting Minutes of July 17, 2023 and the Executive Session Meeting Minutes of July 17, 2023.

All members present voted aye.

CLAIMS, PAYROLL AND DISBURSEMENTS 

Alderperson Whitaker made a motion second by Alderperson Schaefer to approve claims and disbursements in the amount of $2,172,507.47 and payroll in the amount of $1,003,078.41.

Alderperson Eros made a motion second by Alderperson Schaefer to approve the City Attorney's Report dated August 4, 2023.

Motion to approve Treasurer Report June 2023 and a motion to approve Statement of Cash and Investments Report - June 2023

Alderperson Randle made the following motions second by Alderperson Rothweiler:

Motion to approve a contract with Oates Associates in the amount of $100,500.00 for preparation of construction documents for Flood Mitigation plans of Cool Valley (TIF 3 Funds)

Motion to approve Al Asphalt in the amount of $26,700.00 for pavement striping of 17th Street (ARPA Funds) .

ZONING BOARD OF APPEALS 

Alderperson Schnieder made a motion second by Alderperson Schaefer to approve the following motions:

26-JUL23 EVERETT TEMPLE: Request for a Map Amendment to rezone the property commonly known as 4200 North Belt West (08-17.0-100-011) from "C-1" Light Commercial District to "C-2" Heavy Commercial District (Applicable section of the Zoning Code: 162.590) Ward 3 Zoning Board of Appeals recommended APPROVAL, with a vote of 5-0.

28-JUL23 TAYLOR THOMAS, MARCEL ENTERPRISES: Request for a Map Amendment to rezone the property commonly known as 424 Lebanon Ave (08-22.0-118-004,005,014) from “A-2” Two-Family Residence District to "C-1" Light Commercial District (Applicable section of the Zoning Code: 162.590) Ward 1 Zoning Board of Appeals recommended APPROVAL, with a vote of 5-0.

29-JUL23 CITY OF BELLEVILLE ZONING CODE AMENDMENT: Request for amendments of Title XV (Land Usage) of the Revised Ordinances of the City of Belleville, Illinois, Section 162.006

"Definitions" and Sections 162.233, 162.248, 162.263, 162.278, 162.308 and 162.323 "Special Uses". Zoning Board of Appeals recommended APPROVAL, with a vote of 5-0.

All members present voted aye.

27-JUL23 CARDINAL CREEK PROPERTIES, LLC: Request for a Special Use Permit to establish and operate a "Multi-Family Dwelling" apartment complex at 140 Iowa Avenue (08-22.0- 409-021) located in a "D-2” Heavy Industry District. (Applicable sections of the Zoning Code: 162.323, 162.515) Ward 1 Zoning Board of Appeals recommended DENIAL, with a vote of 4-1.

Alderperson Whitaker made a motion second by Alderperson Schneider to deny the request.

Alderperson Whitaker: Mayor, I spoke to Director Cross before the meeting, there is a typo in the Advisory Report that was provided in the packet saying the Zoning Board of Appeals granted by unanimous vote to approve, he said they are going to get that corrected before the final goes out.

Director of Economic Development, Planning & Zoning, Clifford Cross: That is correct, and we are okay with that, it was a typo.

Mayor Gregory: So, it was recommended for denial?

Director of Economic Development, Planning & Zoning, Clifford Cross: It was recommended for denial, it was not unanimous at that point, it was a 4:1 vote recommending denial of the Advisory Report. The Ordinance will come back before you at the next City Council meeting to basically put the kill switch on the project because that is when it is officially approved or denied.

Alderperson Randle made a motion second by Alderperson Rothweiler to approve the following requests:

ROTARY DOG PARK 10TH ANNIVERSARY - 09/09/2023 

Request from Belleville Parks & Recreation to host the Rotary Dog Park 10th Anniversary, Saturday, September 9, 2023, 11:00am to 2:00pm. Additional City services: use of Rotary Dog Park, barrels, electric, picnic tables and staff.

HARVEST FESTIVAL - 09/29/2023 

Request from LongStory Coffee, Belleville Heart Garden and Clara B's to host Harvest Festival, Friday, September 29, 2023, 5:30pm to 9:00pm. Street closures: South High Street north of RR tracks to north of East Grant Street; East Grant from South High to alley; South High from East McKinley to East Grant - local traffic only, 5:00pm to 10:00pm. Additional City services: trash toters, stage and "No Parking" signage.

HOWL'OWEEN PET PARADE AND PRE-PARTY – 10/22/2023 

Request from Belleville Area Humane Society to change the parade route and pre-party location to use of City owned parking lot at East "A" Street, North High and North Jackson Street, Sunday, October 22, 2023, 10:00am to 2:00pm. Parade route change from North High to East Main to North Charles to East "A" Street with rolling closure, 1:00pm to 2:00pm (rain or shine; no rain date)

BELLEVILLE SANTA PARADE - 11/24/2023 

Optimist Club of Belleville requests to host the Santa Parade, Friday, November 24, 2023, 10:00am to 12:00pm. Street closure requests: staging areas 8:00am to 12:00pm; North 3rd Street from West "C" Street to West "A" Street, West "B" Street between N 2nd and N 3rd Street; 10:00am rolling closure along parade route. Additional City services: barricades, No Parking" signage, Police Personnel, Public Works Personnel, and clean-up of parade route.

OLD BELLEVILLE LUMINARY WALK – 12/09/2023 

Request from Gustav Koerner House, Belleville Historical Society, St Clair County Historical Society and Neighbors of Abend/Garfield Streets to host Old Belleville Historical Luminary Walk, Saturday, December 9, 2023, 5:00pm to 9:00pm. Street closure request: East Garfield (Mascoutah Avenue to Abend alley); Abend (Mascoutah Avenue to Washington School parking lot entrance), 12:00pm to 10:00pm. Additional City services: street sweeping, "No Parking" signage and event signage with lighting.
