City of Edwardsville Administrative and Community Services Committee met Nov. 6.

Here is the minutes provided by the Committee:

Present:

PUBLIC COMMENT: None

1. Approval of minutes for November 2, 2017 ACS Meeting-Motion to approve (Morrison), Seconded (Krause) and voted all ayes.

Council Matters

A.) FILED FOR SECOND READING:

1.) An Ordinance Amending Chapter 22, Article VII (Tobacco Products) and Chapter 74, Division 2 (Possession of Tobacco Products and Accessories) of the Codified Ordinances of the City of Edwardsville - Would regulate the use of electronic Smoking devices in the Same manner as tobacco products - Motion to approve (Morrison), seconded (Krause) and voted all ayes to forward to Council.

B.) NEW TEMS:

1.) Resolution Accepting the Request for Proposal from Gori Properties, LLC for the sale of the Former Public Safety Building and the Mayor to Negotiate an AgreementResolution accepts the Reduest for Proposal for the sale of 400-410 N. Main Street to Gori Properties, LLC for a proposed five story, 60,000 square foot, Class A, professional office space with 10,000 square feet of ground floor retail, for a total of 70,000 Square feet. The primary tenant will be GoriJulian & Associates, PC. The lower level (underground) of the building is intended to serve as a parking garage - Alderman Morrison stated he is pleased with this proposal. Alderman Krause agrees with this. Motion to approve (Morrison), seconded (Krause) and voted all ayes to forward to Council.

2.) An Ordinance Amending Chapter 114, Article II, Division 3 of the Codified Ordinances of the City of Edwardsville - Intersection of Home Avenue and Brinkman Street - This ordinance establishes stop signs for Westbound and eastbound Brinkman Avenue at the intersection of Home Avenue (Pending recommendation from Public Safety and Public Services Committees) - Both Public Safety and Public Services have recommended this. This request is from Alderman Farrar. He feels this is important for this neighborhood. Motion to approve (Krause), Seconded (Morrison) and voted all ayes to forward to Council.

C.) ITEMS HELD IN COMMITTEE:

1.) Edwardsville Cool Cities Climate Action Plan (discussed as new business and held at ACS 8/10/17) - Will continue to hold.

2.) An Ordinance Amending Chapter 14 Animals - Domesticated Chickens - The amendment to the animal ordinance would allow licensing for keeping domesticated chickens - This is an updated version of the ordinance from the feedback and comments from the last ACS meeting. They are still allowing for the licensing of up to 6 hens within the City. When you apply for a permit, you will need to have a rodent control plan and a chicken Coop maintenance plan. The number of chickens you would have on site would be stated based on the size of the coop and run. You would have to have standard setbacks as any accessory structure would. A building inspector would inspect the site for Conformance. Then a permit would be issued from the Clerk's office. The first year would be a $50 fee that would be renewed annually for $25 after that. If there would be a violation of the ordinance and the CSO's would revoke your license, you would have 72 hours to remove the hens from the property and could not reapply for 3 years. The number of licenses available for this has been decreased to 40. Waste would have to be collected in a sealed container. If composting, it would have to be done with hay, bedding, or leaves in a commercially purchased composter. If the ordinance would get revoked in the future, you would be allowed to keep the chickens up until their death or removal. The subdivision covenants were also removed based on the feedback from homeowner's associations that they did not want to be responsible for enforcement. The subdivision Covenants will still stand though. Alderman Risavy was asked to discuss the individuals who are currently violating the ordinance of not having chickens. He stated there is concern with allowing them to continue to have chickens if this ordinance passes. He was also asked what the process would be if a chicken got out. Alderman Krause stated it should be the homeowner's responsibility. They would need to be contacted to Collect the chicken. If they could not be located, there is currently no plan in place to deal with a loose chicken after hours. It was suggested that on the application there be the names of 2 people with phone numbers to contact to take care of this. There was discussion as to what would be the best way to deal with identifying a loose chicken and also possible reclamation fees. Motion to forward to Council for first reading (Krause), seconded (Morrison) and voted 2 ayes and 1 nay (Risavy).
