City of Belleville Ordinance & Legal Review Committee met Feb. 13.

Alderman Wigginton called the meeting to order.
Aldermen present on roll call: Alderwoman Pusa, Alderman Randle, Alderman Wigginton, Alderwoman Stiehl.
Alderman absent on roll call: Alderman Hazel.

Alderwoman Pusa made a motion seconded by Alderwoman Stiehl to accept the minutes of January 9, 2018.

Consideration Of Ordinance Revising Section 33.024 (Auxiliary Police Officers)
Alderman Wigginton advised this item will be brought back for future consideration.
Consideration Of Ordinance Revising Section 154.46(A)(3) Rental Property Registration Form (Crime Free Housing)
City Attorney Hoerner stated this proposed amendment arose from the meeting of the Crime Free Housing Committee. There were issues associated with late or non-payment by those that are subject to the crime free housing program. The committee suggested the registration will double ($50) if it is not paid in a timely fashion (no later than two weeks late - November 15th).
Discussion.
Alderman Wigginton asked if this is something that will be easy to implement; Director of Health and Housing, Bob Sabo, stated yes.
Alderman Ovian stated he introduced that on November 15th it would double and if it was not paid by November 30th the loss of occupancy permit or rental unit would be mandatory. Director of Health and Housing, Bob Sabo, stated this is already in the current ordinance.
Alderwoman Stiehl stated it reads registration may be denied by the City at any time.
Alderman Wigginton asked if everyone is happy with doubling the fee from $25 to $50. Director of Health and Housing, Bob Sabo, stated this is what the crime free housing committee recommended.
Alderwoman Pusa made a motion seconded by Alderwoman Stiehl to approve revising Section 154.46(a)(3) Rental Property Registration Form (Crime Free Housing).

Alderman Randle asked if the increase is permanent; Director of Health and Housing, Bob Sabo, stated only for that year.
Alderman Ovian asked what if they come in with partial payments; Alderwoman Stiehl recommend adding the language "paid in full".

Consideration Of Ordinance Revising Sections 51.001 To 51.999 User Charges (Sewers)
Alderwoman Stiehl made a motion seconded by Alderwoman Pusa to approved revising Section 51.001 to 51.999 User Charges (Sewers).
Discussion.
City Attorney Hoerner stated this is to change the fees directed by the IEPA for compliance.

Consideration Of Ordinance (Adult Entertainment Districts)
Alderman Randle made a motion to postpone until the next meeting.
Discussion.
City Attorney Hoerner stated there are a couple of areas within the documents that needs determination by the committee as to the zoning district for special use. Historically the adult entertainment establishments are put into industrial districts. There are heavy industrial and light industrial districts. There should be enough area to satisfy the constitutional requirement. Those two areas collectively would be because they are distributed throughout the City.
Alderman Randle asked the maps and ordinance be distributed to every alderman on city council so when this is considered that every alderman be invited to the ordinance and legal meeting.
Consideration Of Ordinance Revising Section 121.28 (Underage Sales)
Alderwoman Pusa made a motion seconded by Alderwoman Stiehl to approve revising Section 121.28 (Underage Sales).
Discussion.
City Attorney Hoerner stated this is a draft ordinance that clears up the issue of having a wait staff that is under the age 21 and over the age 18. This will allow one to possess alcohol since it is part of their job and one can only permit a person under the age of 21 to handle, sell and serve alcohol if a Class A and B license. (less than 21 years old are not allowed behind the bar)
Alderman Randle asked if a person is 18 or older they can alcohol take from the bar on a tray and deliver it to the table or person who ordered the drink and what is being defined here is the person may not be able to draw the beer or pour the alcohol into a glass and then serve; City Attorney Hoerner advised that is correct.
Alderman Wigginton recommended placing approved/revised ordinances in the Newsletter.

Consideration Of Ordinance Revising Section 118.16 (Convenience Stores - Definitions)
Alderwoman Stiehl made a motion seconded by Alderwoman Pusa to approve revising section 118.16 (Convenience Stores - Definitions).
Mayor Eckert stated this council passed a revised ordinance regarding Jack Flash. There has been a request from Moto Mart (location is Fullerton and Rt 161) to have a truck stop with a gaming room.
A stipulation for Jack Flash was two miles from the interstate. Can the requirements be revised to include it must be on a State highway and have a minimum of 5000 square foot building? This property will be a good revenue producer. Alderman Randle asked when this was originally done what was the reason for within two miles of an interstate; City Attorney Hoerner stated this was a restriction to keep them on the highway. An example of a truck stop in the meaning of this is the Circle K in Shiloh, IL. The advantage under the Video Gaming Act is they are allowed to have machines without a pour liquor license.
Alderman Randle stated the landscape of the City has changed over the years. The once fully serviced gas stations were turned into convenience stores. There are locations Rt 177, Rt 13, Rt 161, Rt 15 as well as the Belt Line that will qualify if they can get zoned.
