City of Belleville Zoning Board of Appeals met March 28.

The Zoning Board of Appeals meeting was held at Belleville City Hall, Council Chambers, 101 South Illinois Street.

The meeting was called to order at 7:00 p.m. by Chairman Nollman. Roll was called and a quorum declared.

Chairman Nollman noted that Zoning Board all cases heard at this meeting, with the exception of 20-Mar-18, will be considered at the April 16, 2018 City Council meeting. Chairman Nollman explained the emergency procedures if needed.

Chairman Nollman asked if there were any corrections to be noted for the February 22, 2018 Zoning Board of Appeals meeting minutes. No corrections were made hence the minutes were approved by the Board.

The following cases were heard:

➢ 16-MAR18 - John Anderson - A request for a Special Use Permit to establish a metal building larger than 150 Square Feet at 703 Schlueter Germaine Road (Parcel number: 13-11.0-100-033) located in an "A-1" Single- Family Residence District. (Applicable sections of the Zoning Code: 162.094, 162.515) Ward 5

Applicant John Anderson explained he is proposing to build a pole barn on private property. He stated that the foot print of the existing residence located on the subject property is approximately 3,000 Square Feet (SF) and the proposed pole barn is 2,200 SF. He continued to explain that the residence is brick and the pole barn would have metal siding with two tone colors between the bottom half and the top half. Mr. Anderson clarified that the uses within the pole barn would consist of wood working-related activities and storage of personal vehicles/lawn care equipment. Mr. Anderson stated he plans to add lighting in the future and that the roof would be made of metal.

There were no public comments or Aldermen comments made regarding this request.

With no further discussion, Chairman Nollman asked for a motion.

A motion was made by Rebecca Boyer to Approve the request. It was seconded by Tim Price. All members present voted in the affirmative. The motion carried 4-0.

➢ 17-MAR18 - Bennie Parr Jr. - A request for a Sign Installation Permit in the Area of Special Control for signage at 124 East Main Street (Parcel number: 08-22.0-338-049) located in a "C-2" Heavy Commercial District. (Applicable sections of the Zoning Code: 155.052, 155.053) Ward 6

Applicant Bennie Parr Jr. explained he would like to establish new signage for his future business, Bennie's Pizza Pub. He stated they are using the existing awning for their signage.

There were no public comments or Aldermen comments made regarding this request.

With no further discussion, Chairman Nollman asked for a motion.

A motion was made by Rebecca Boyer to Approve the request. It was seconded by Toni Togies. All members present voted in the affirmative. The motion carried 4-0.

The following two cases were heard together, but voted upon seperately.

➢ 18-Mar18 - GSM Belleville, LLC - A request for a Special Use Permit to establish a metal building larger than 150 Square Feet at 17 Royal Heights Centre (Parcel number: 08-08.0-202-007) located in a "C-2" Heavy Commercial District. (Applicable sections of the Zoning Code: 162.248, 162.515) Ward 3

➢ 19-Mar18 - GSM Belleville, LLC - A request for a Special Use Permit to operate a storage building at 17 Royal Heights Centre (Parcel number: 08-08.0-202-007) located in a "C-2" Heavy Commercial District. (Applicable sections of the Zoning Code: 162.248, 162.515) Ward 3

Applicants Todd Erbs and Alex Erbs explained they are planning to add two storage buildings in addition to the one existing storage building on the subject property. They continued to describe the planned building along the front lot line as a double sided storage building and the building along the west side lot line as a single sided storage building. They stated that the existing building is used for storage and has 15 to 20 doors on each side and that the other existing structure was previously a car wash vacuum bay. They applicants stated they plan to match the existing building as closely as possible and they are currently in discussions with the Fire Department to ensure adequate space for Fire Department vehicles to maneuver between buildings on the property.

They stated they will try to match the existing building's color scheme of grey roofing and grey doors with grey siding. They continued to explain that the existing vacuum bay would remain the same for now and that they plan to fence in the entire property with aluminum fencing in the future. The applicants added that their future plans include security cameras, new lighting, a manual gate, and a small office.

The applicants continued to say that storage customers have 24 hour access to the units and that they are making drainage improvements in addition to lighting improvements for the existing building. The applicants stated they do not plan to have outdoor storage on the property at this time.

There were no public comments made regarding this request.

Aldermen comments:

Scott Tyler of Ward 3 commented that the surrounding area has been much improved in the last five years and he has no issues with the request.

With no further discussion, Chairman Nollman asked for a motion. 

18-Mar18: A motion was made by Rebecca Boyer to Approve the request. It was seconded by Tim Price. All members present voted in the affirmative. The motion carried 4-0.

19-Mar18: A motion was made by Rebecca Boyer to Approve the request. It was seconded by Toni Togies. All members present voted in the affirmative. The motion carried 4-0.

➢ 20-Mar18- City of Belleville Zoning Code Amendment - An ordinance amending Title XI (Business Regulations) of the Revised Ordinances of the City of Belleville, Illinois as amended, by adding Chapter 122 (Adult Entertainment Businesses), Sections 122.001 through 122.015

Economic Development Director Annissa McCaskill explained the code amendment as a request brought forward by the City of Belleville through the Ordinance and Legal Committee. She continued to say there is an identified need for regulations regarding adult uses; specifically, what is considered an adult use, licensing, and where they can be located.

Ms. McCaskill stated that the Ordinance and Legal Committee and the City Attorney have drafted a recommendation for the amendment. Ms. McCaskill proceeded to explain the draft recommendation. The recommendation requested that Adult Uses be added as Special Uses to the Light Industrial and Heavy Industrial Zoning Districts. Ms. McCaskill added that there would be requirements for Adult Uses in addition to the Special Use criteria. Applicability definitions and procedures would be created to review an Adult Use request and a business license fee of $1,000 would be established in addition to penalty fees / penalty fee schedules. Ms. McCaskill made note that the business licenses for Adult Uses would be non-transferable.

Ms. McCaskill specified that the Adult Use cannot be less than 1,000 feet from any other site containing an adult use according to the draft recommendation. Ms. McCaskill continued to explain that an Adult Use cannot be within 1,000 feet of a church, school, public building, public park, recreation area, or residence zoned district according to the draft recommendation. In addition, Ms. McCaskill informed that the draft recommendation does not allow for an Adult Use within any building that serves a residential purpose.

Ms. McCaskill clarified that the request before the Zoning Board of Appeals is to recommend approval of the amendment to City Council with the stipulation that Adult Uses be added to the Special Uses section of the Light and Heavy Industry Zoning Districts.

There were no public or Aldermen comments made regarding this request.

With no further discussion, Chairman Nollman asked for a motion.

A motion was made by Rebecca Boyer to Approve the request with the following stipulation (1.) The Adult Uses be added to the Special Uses sections 162.308 Light Industry District and 162.323 Heavy Industry Zoning District. It was seconded by Toni Togias. All members present voted in the affirmative. The motion carried 4-0.

Ms. McCaskill informed that Zoning Board of Appeals (ZBA) member Toni Togias will no longer be serving on the ZBA and thanked Ms. Togias for her years of service and dedication to serving as a ZBA member. All in attendance proceeded to applaud Ms. Togias for her dedication and service.

Ms. McCaskill announced that Amy Toenjes is the new secretary for the Economic Development, Planning and Zoning Department.

Rebecca Boyer made a motion to Adjourn, which was seconded by Tim Price. All members present voted in the affirmative. Chairman Nollman adjourned the meeting at 7:25 p.m.
