Village of Smithton Board of Trustees met Dec. 3.

Here is the minutes provided by the board:

The Village Board meeting was called to order at 7:30pm with everyone reciting the Pledge of Allegiance. Trustees Becherer, Rogers, Elbe, Henning and Mourey answered roll call. Trustee Yoch was absent.

CLERK’S REPORT

The Board received a copy. A motion was made by Trustee Becherer which was seconded by Trustee Rogers to approve the minutes from the board meeting that was held on November 19, 2019. Roll call was taken: Trustee Becherer, aye; Trustee Rogers, aye; Trustee Elbe, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent. Motion was granted.

TREASURER’S REPORT – No report.

GOOD OF THE VILLAGE

Attorney Durso informed Mike Middendorf that the board would not be able to speak to Middendorf or Neal Trentman regarding the subject of their storage unit property since Durso is corresponding with their attorney.

POLICE CHIEF’S REPORT: Chief Neff summarized the police department call record for November.

They received 76 calls. 42 traffic stops were made. They responded to 6 accidents.

POLICE PERSONNEL

Trustee Becherer made a motion which was seconded by Trustee Mourey to hire Griffin Diecker as a full-time police officer effective December 28, 2019. Roll call was taken: Trustee Becherer, aye; Trustee Mourey, aye; Trustee Rogers, aye; Trustee Elbe, abstain; Trustee Henning, aye; Trustee Yoch, absent. Motion was granted.

Clerk Parker swore in Griffin Diecker as the new full-time police officer for Smithton.

ENGINEER’S REPORT

PARK GRANT APPLICATION – No update.

CDBG – No update.

EAST/WEST GATEWAY GRANT APPLICATION – No update.

HEALTH OFFICER’S REPORT: No report.

SAFETY COMMITTEE

Mayor Smallwood reported that there is a Safety Committee Meeting scheduled for January 2, 2019 at 10:00am, if needed.

ZONING BOARD REPORT

Zoning Administrator Saeger reported that there are two zoning hearings scheduled for December 9, 2019. One is for a variance request for shed height and setbacks at 215 S. Hickory St. and the other is to review the final plat for the Villas at Sand Rock Creek.

SUPERVISORS REPORT

Supervisor Klein reported that a flow meter was replaced at the wastewater treatment plant.

Supervisor Klein reported that the street sweeping has been completed.

ATTORNEY’S REPORT

Attorney Durso asked about the progress of the rental property registration/inspection ordinance that he had reviewed. Trustee Rogers stated that it was discussed at the Committee As a Whole meeting and that it is near completion. Durso will review the final draft.

Attorney Durso reported that a state statute was passed that requires sexual harassment training after January 1, 2020, but it will not be enforced since the state has not provided guidelines yet.

Trustee Becherer made a motion which was seconded by Trustee Rogers to accept the officer’s reports as given. All were in favor. Motion was granted.

COMMITTEE AS A WHOLE

Mayor Smallwood reported that there was a Committee As a Whole meeting on November 26, 2019. The items will be discussed under the individual committee reports. Trustee Becherer made a motion which was seconded by Trustee Rogers to approve the minutes from the Committee As a Whole meeting on November 26, 2019. Roll call was taken: Trustee Becherer, aye; Trustee Rogers, aye; Trustee Elbe, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent. Motion was granted.

FINANCE & INSURANCE COMMITTEE – No report.

Mayor Smallwood would like to discuss the budget at the next Committee As a Whole meeting.

STREET & UTILITY COMMITTEE

WASTEWATER LAGOON PROPERTY LEASE – No update.

NEW STREET DEPARTMENT TRUCK – No update.

STORM WATER DRAINAGE – No update.

POLICE COMMITTEE

Trustee Elbe made a motion which was seconded by Trustee Becherer to take Officer Sean Adams off of probation. Roll call was taken: Trustee Elbe, aye; Trustee Becherer, aye; Trustee Rogers, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent. Motion was granted.

PARK & CEMETERY COMMITTEE

CAMERAS AT THE PARK, POLICE DEPARTMENT & MAINTENANCE SHED

Trustee Henning reported that he is waiting for the revised camera repair bid.

PARK BUILDING GRANT – No update.

MEPRD FY20 PARK & TRAIL GRANT PROGRAM – No update.

GRAVESTONE REPAIRS

Trustee Henning stated that Weiss monument came out to look at the gravestones. Henning will contact them.

911 MEMORIAL – No update.

PARK TREES & LAKE ROCK – No update.

ORDINANCE COMMITTEE

ORDINANCE 926-APPROPRIATIONS

Trustee Becherer made a motion which was seconded by Trustee Rogers for Clerk Parker to read Ordinance 926 by Title only. Roll call was taken: Trustee Becherer, aye; Trustee Rogers, aye; Trustee Elbe, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent. Motion was granted. After Clerk Parker read Ordinance 926 by Title only, Trustee Becherer made a motion which was seconded by Trustee Rogers to pass Ordinance 926-Appropriations. Roll call was taken: Trustee Becherer, aye; Trustee Rogers, aye; Trustee Elbe, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent. Motion was granted.

ORDINANCE 927-IRRIGATION METERS

Mayor Smallwood stated that Clerk Parker is working on a draft for this ordinance. This will be on the agenda at the next Committee As a Whole meeting.

ORDINANCE 928-TAX LEVY

Trustee Becherer made a motion which was seconded by Trustee Rogers for Clerk Parker to read Ordinance 928 by Title only. Roll call was taken: Trustee Becherer, aye; Trustee Rogers, aye; Trustee Elbe, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent.  Motion was granted. After Clerk Parker read Ordinance 928 by Title only, Trustee Becherer made a motion which was seconded by Trustee Rogers to pass Ordinance 928-Tax Levy. Roll call was taken: Trustee Becherer, aye; Trustee Rogers, aye; Trustee Elbe, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent. Motion was granted.

ORDINANCE 929-CANNABIS

Mayor Smallwood reminded the board that they must take action on a cannabis ordinance at the next Board meeting since it must be done before January 1, 2020. This will be discussed at the next Committee As a Whole meeting.

RENTAL PROPERTY REGISTRATION/INSPECTION ORDINANCE – No update.

ORDINANCE VIOLATIONS – No update.

ANNEXATION AND BUILDING COMMITTEE

SALT STORAGE BUILDING – No report.

VILLAGE HALL GENERATOR – No report.

BILLS AND PAYROLL

Trustee Becherer made a motion which was seconded by Trustee Rogers to authorize Clerk Parker to pay November bills and payroll from November 16, 2019 through November 29, 2019. Roll call was taken: Trustee Becherer, aye; Trustee Rogers, aye; Trustee Elbe, aye; Trustee Henning, aye; Trustee Mourey, aye; Trustee Yoch, absent. Motion was granted.

Trustee Rogers made a motion which was seconded by Trustee Elbe to adjourn. All trustees were in favor. Motion was granted to adjourn at 7:50pm.
