Illinois State Representative Introduces Legislation to Protect Privacy of Law-Abiding Gun Owners

As law-abiding gun owners in Illinois continue to register their firearms with the Illinois State Police, State Representative Amy Elik (R-Alton) has filed legislation to safeguard the privacy rights of these individuals in light of ongoing Constitutional challenges to the state's gun ban.

"My legislation ensures that if certain gun-related provisions are found unconstitutional, the information collected from law-abiding gun owners when registering their firearms is immediately destroyed," explained Rep. Amy Elik. "This protects the privacy of law-abiding gun owners, preventing the government from retaining their personal information."

Under Rep. Elik's proposed legislation, known as HB 4150, the Illinois State Police would be required to promptly and permanently destroy the gun registry of all law-abiding gun owners in the event that Illinois' gun ban is deemed unconstitutional. As various Constitutional challenges progress through the federal court system, the State Police would be mandated to eliminate every endorsement affidavit and any associated information collected during the registration process, including records held by other law enforcement agencies.

Effective October 1, 2023, law-abiding gun owners are required to register specific firearms purchased before January 10, 2023, with the Illinois State Police by January 1, 2024. The complete list of firearms subject to registration can be found here. It is important to note that these firearms were banned from future purchases in Illinois as of January 10, 2023.
