Passed bill authored by State Rep. Katie Stuart seeks to enhance oversight of public universities by mandating Board of Higher Education approval for new academic units and periodic program reviews, according to the Illinois General Assembly.

In the House, 75 Democrats and 40 Republicans voted in favor of the bill.

Meanwhile, in the Senate, 38 Democrats and 19 Republicans voted in favor of the bill.

Stuart introduced the bill in the Illinois House on Feb. 6, 2025 during the 104th session.

The legislation, known as HB3300, was passed on May 30, 2025 during the general assembly session 104.

According to the Illinois General Assembly site, the legislature summarized the bill's official text as follows: "Amends the Board of Higher Education Act. Removes language providing that: each State university shall report annually to the Board on programs of instruction, research, or public service that have been terminated, dissolved, reduced, or consolidated by the university, and all programs of instruction, research, and public service that exhibit a trend of low performance in enrollments, degree completions, and high expense per degree; and the Board shall compile an annual report that shall contain information on new programs created, existing programs that have been closed or consolidated, and programs that exhibit low performance or productivity. Instead, requires the Board to annually identify and provide to each public university certain programs of instruction that exhibit indicators of low performance in enrollment, degree completion, and relative high expense per degree, and for each public university to review such information and report annually to the Board with its proposed performance improvement plan for each identified program. Requires the Board to report annually on the instructional programs offered at public institutions of higher education, to show number, types, and locations of instructional programs, new programs created, existing programs that have been closed or consolidated as a result of the review and report above, and other information relevant to assessing the State's portfolio of programs. Requires the report to be submitted to the General Assembly and the Governor (not only the General Assembly). Amends the Private College Act. Provides that applications submitted to the Board of Higher Education shall contain a statement, among others, regarding the tuition schedule. For a disclosure regarding heightened monitoring of the institution's finances, requires the disclosure to be made, among others, by written notice to the Board. Amends the Academic Degree Act. Requires an educational organization or entity that awards degrees and qualifies for degree granting to maintain appropriate accreditation to provide educational programming. Makes other changes. Effective immediately."

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill mandates that public universities and colleges in Illinois obtain approval from the Board of Higher Education before establishing new units of instruction, research, or public service. It allows the board to periodically review all academic programs at these institutions, excluding community colleges, to assess educational and economic value. The board will identify underperforming programs and require universities to submit performance improvement plans. Additionally, the bill permits these institutions to accept gifts, create and participate in various entities for educational purposes, and distribute grants. Amendments also require private post-secondary institutions to disclose if placed under federal financial monitoring and clarify the conditions under which non-residential institutions can award degrees. The bill becomes effective upon becoming law.

The bill was sponsored by Sen. Cristina Castro (Democrat-22nd District) and Sen. Kimberly A. Lightford (Democrat-4th District).

Bills in Illinois follow a multi-step legislative process, beginning with introduction in either the House or Senate, followed by committee review, floor debates, and votes in both chambers before reaching the governor for approval or veto. The General Assembly operates on a biennial schedule, and while typically thousands of bills are introduced each session, only a fraction successfully pass through the process to become law.

Stuart, a Democrat, was elected to the Illinois State House in 2017 to represent the state's 112th House District, replacing previous state representative Dwight Kay.

Lawmakers listed as "Not Voting" were present for the vote but did not cast a vote. Those marked as having an "Excused Absence" were not present and formally provided a reason for their absence, which was accepted.
