City of Belleville Ordinance & Legal Review Committee met March 13.

Here is the minutes provided by the Committee:

Alderman Wigginton called the meeting to order.

Aldermen present on roll call: Alderman Hazel, Alderman Randle, Alderman Wigginton, Alderwoman Stiehl.

Alderman absent on roll call: Alderwoman Pusa.

Staff Present: City Attorney Hoerner, City Clerk, Jenny Meyer, City Treasurer Hardt, Director of Economic Development, Annissa McCaskill.

Public Participation:

None.

Minutes:

Alderman Randle made a motion seconded by Alderman Hazel to accept the minutes of February 13, 2018.

All members present voted aye.

Unfinished Business:

None.

Miscellaneous & New Business:

Consideration of Ordinance Amending Title XI (Business Regulations) of the Revised Ordinances of the City of Belleville, Illinois as Amended by Adding Chapter 122 (Adult Entertainment Businesses), Section 122.001 through 122.015.

Alderman Randle made a motion seconded by Alderman Wigginton to approve amending Title Title XI (Business Regulations) of the Revised Ordinances of the City of Belleville, Illinois as Amended by Adding Chapter 122 (Adult Entertainment Businesses), Section 122.001 through 122.015.

Discussion.

Alderman Hazel stated in looking over the requirements for these types of businesses it is noted in the proposed ordinance that it shall not be permitted on a site less than 250 feet from any residentially zoned land. He requested to have this researched and suggested at a minimum 500 feet. This can be found in 122.009(c)(d) and 122.010(c).

City Attorney Hoerner suggested if you would like to maximum businesses above what would be otherwise considered the norm he would like to have a case to rely upon. To clarify you would like to maximize the residential up to 1000 based upon any case law he finds.

Alderman Hazel made a motion seconded by Alderman Randle to amend to include permitted feet, fees (city attorney will research) and light and heavy industrial area in a special use and in the name of the applicant only.

Alderman Randle asked if this will be light or heavy industry. City Attorney Hoerner stated confining it to both industrial zones.

Director of Economic Development, Annissa McCaskill, stated in part that must be looked at is also the process by which they would be approved. Anyone that would apply for this license would have to come through the council for a special use permit and would have to meet all standards. With the Zoning Boards' recommendations the aldermen must heavily way their recommendation and interpretation based upon their discussion of how it would impact the neighborhood, how it will influence the city's tax base and whether or not it will be beneficial or detrimental to the community.

Director of Economic Development, Annissa McCaskill, stated this license is not transferrable.

City Attorney Hoerner stated the fee should be maximized according to case law.

Police Officer Hackleman, stated when you look at the surrounding areas that have this type of establishment and the incidents that occur this is not something we want in our city. These establishments bring narcotics, prostitution, random acts of violence, shootings. While the establishment have private security the private security do not have the powers to arrest.

All members present voted aye.

Alderman Randle made a motion seconded by Alderwoman Stiehl to adjourn the meeting at 6:58 p.m.
