Governor JB Pritzker has signed Senate Bill 328 into law, a measure that State Representative Kevin Schmidt (R-Millstadt) says will negatively affect Illinois’ business environment. According to Schmidt, the legislation is likely to increase lawsuits against companies operating in the state.

“Illinois is struggling with population loss and job growth, and this law will impede economic development even more,” Schmidt said. “This bill was passed despite not following the procedures outlined in the House Rules. This bill penalizes businesses, stifles investment, and fuels a legal climate that welcomes frivolous lawsuits. I stand with the job creators in our state who have taken a strong position against this bill.”

House Republicans are contesting SB328 in Sangamon County Circuit Court, arguing that legislative procedures were bypassed through a “gut-and-replace” tactic on the last day of the spring 2025 session. They claim this action violates the Illinois Constitution’s Three Readings Rule.

The new law mandates that any company registered to do business in Illinois must consent to the state’s general jurisdiction. This means such companies could face lawsuits in Illinois courts regardless of where plaintiffs are from or where alleged harm occurred.

Schmidt was elected as a Republican to represent Illinois’ 114th House District in 2023, succeeding LaToya Greenwood.
