'Individual freedom must prevail': Davidsmeyer celebrates judge's decision blocking vaccine mandate

Illinois state Rep. C.D. Davidsmeyer praised a federal judge who blocked a healthcare worker vaccine mandate nationwide in a Facebook post. 

On Nov. 30, Judge Terry A. Doughty granted a preliminary injunction against the Center for Medicare and Medicaid Services mandates, which required that staff members at Medicare and Medicare health providers must receive at least one COVID-19 vaccine dose by Dec. 6 and the second by Jan. 4, ABC 20 reported.

"Individual freedom must prevail over these mandates," Davidsmeyer posted to Facebook.

Doughty's decision was clear and decisive. 

"The U.S. Department of Health and Human Services and the Center for Medicare and Medicaid Services, along with their directors, employees, Administrators and Secretaries are hereby ENJOINED and RESTRAINED from implementing the CMS Mandate set forth in 86 Fed. Reg. 61555-01 (November 5, 2021) as to all healthcare providers, suppliers, owners, employees, and all others covered by said CMS Mandate," Judge Doughty said in his decision. 

Doughty went on to discuss the scope of his ruling in the decision. 

"This preliminary injunction shall remain in effect pending the final resolution of this case, or until further orders from this Court, the United States Court of Appeals for the Fifth Circuit, or the United States Supreme Court," Doughty continued. 

The mandate would have impacted 17 million workers nationwide. Employees in violation of the policy would have been penalized with a termination of their Medicare agreement. Despite Doughty's ruling the final decision will rest with a higher court.
